Congress has passed legislation intended to double the number of FBI mortgage fraud task forces and to close legal loopholes that have prevented federal prosecutors from filing fraud and money laundering charges against many mortgage lenders.

In a 338-52 vote, the House of Representatives this week signed off on Senate Bill 386, the Fraud Enforcement and Recovery Act of 2009.

I don't care how much firepower the FBI gets in the fight against mortgage fraud it comes down to manpower or a lack of it.

I tried reporting a case of mortgage fraud to the FBI, the Attorney General in AZ, the Department of Financial Institutions, The Arizona Association of Realtors last year and had road blocks thrown up at every turn.

The only help was from the Arizona Association of Realtors who did investigate and felt there was loan fraud committed but since they lacked the legal ability to requst financial records etc, they also came to a dead end.

Six months of work trying to turn in a clear case of loan fraud that I refused to participate in was for nothing. Everyone basically told me they did not have enough resources to take on any additional cases of mortgage fraud.

In addition to any new tools the FBI is provided to fight fraud, they need additional money and manpower. Permalink

He has since signed up with 2 more mortgage companies over the next 2 years and is still originating. The state can't talk to me about him as it is an on going investigation and can take up to 7 years to complete. . ."WHAT?"

We called the FBI regarding a file that was 'absolute' loan fraud & they directed us to the Secret Service. Within 2 hours we had agents in our office and the closing was set to and all parties were caught in the act! You have to contact a specifice unit of the Secret Service to get action. In all honesty, however, at least as much blame can be placed on the US Attys Office. Unless you have someone willing to confess on the spot, they don't have the time.
