The problem with fraud is that it's hard to prove. The circumstances, events and discrepancies may be documented and validated. The hard part is the 'who' - who actually committed fraud. Some legal entity needs to have a conversation with this Loan Officer. Though the borrower did raise their concerns, if they still went ahead and closed the loan - knowing these issues - in my opinion, there is negligence on their part as well. Permalink
