``... mortgage servicers have no shortage of excuses for almost universally ignoring the mediation program. To a degree, their complaints are legitimate. They are right to craft proposals to present to the 2013 Legislature to help remedy flaws in mortgage-mediation enabling legislation and to offset the effects of the court ruling.

But the industry has four months to assemble a legislative package. Its immediate goal should be to find a way to help more at-risk homeowners find an alternative to foreclosure. The recent setbacks might make it more difficult for lenders to use the mediation program, but it does not make it impossible for them to modify mortgages in a way that benefits lenders and homeowners.
