``To assist in this vital legal fight, the Nevada attorney general's office hired private counsel. The contract was approved by all necessary state entities. Since we filed the case on Dec. 15, 2011, LPS has unsuccessfully sought--twice--to dismiss the state's lawsuit. LPS filed--and lost--its own lawsuit against the state in federal court. LPS's latest tactic is to try and weaken the state's resources against it.
LPS's argument that I cannot use private counsel impedes my ability to protect Nevadans from an out-of-state corporation whose irresponsible and unparalleled conduct has undermined our economy. Its argument is also wrong on the law: Nevada attorneys general have used private counsel to assist them numerous times, including in litigation with tobacco companies that resulted in establishment of the Gov. Guinn Millennium Scholarship program.
