If MERS has no standing at the time of foreclosure, it is logical to assume that it has no standing while the mortgage is in effect, correct? But if a Class Action rules that all MERS mortgages are fraudulent, the banks and holders of the MBS stand to lose it all, while all mortages under MERS then are canceled to benefit of the property owners, correct? Its a nightmare scenerio for the financial system, but seems like a possible outcome of all of this to me. Permalink
