I watched him in court one day where I was to testify as an expert witness in one case. The husband and wife were being evicted in an Unlawful Detainer action. I could show absolute proof that the foreclosure process was unlawful.

Judge Pierce refused to hear any evidence, instead just asking the attorney for US Bank in whose name the property was recorded. Of course, since it had been unlawfully foreclosed upon, US Bank had the property. Judge Pierce claimed he could only abide by the recorded owner.

The reality is much different. UD Courts are listing to Title claims and ruling that the foreclosure is unlawful more and more. It is just that certain judges don't want the additional workload that would come with ruling on UD and Title claims.

The reality is that I can prove that up to 70% of the foreclosures in California are procedurally flawed, and therefore, the foreclosure is unlawful. Permalink
